THAT following a hearing before the Licensing and General Purposes Sub

Committee (the Licensing Panel)

 

ON 13 April 2017

 

HOUNSLOW COUNCIL, as the Licensing Authority for the premises

 

RESOLVED TO TAKE THE FOLLOWING STEPS IN RELATION TO THE APPLICATION:

 

That the application for the renewal of the licence be REFUSED for the reasons set out below.

 

 

Licensable activities:

 

Manicure, pedicure, body piercing and tattooing.

 

 

REASONS:

 

This was an application for the renewal of the Special Treatment Licence under the London Local Authorities Act 1991 in respect of Yankee's Hair Beauty Tattoo Piercing Studio, 109 High Street, Hounslow TW3 1QT. 

 

One representation was received from the Council’s Health and Safety Team, referring to the fact that the licence holder had previously been prosecuted under the London Local Authorities Act 1991 and was also subject to further legal action. The receipt of a representation required the matter to be brought before the Licensing Panel.

 

Mr Michael Dhliwayo, a family friend of the licensee acting as his representative, requested that the hearing be adjourned on the ground that its outcome may prejudice legal proceedings to take place later that month. The request was refused. There was firstly no requirement for the Panel to make any finding as to Mr Aslim’s guilt or innocence of the charges, but merely to consider the factors set out in The Act. The criminal proceedings should not be influenced in view of the higher burden of proof required in the Magistrates Court.

 

Lewis Aldous, Council Licensing manager, presented the report (item 2 of the agenda).

 

The objection, presented by Graham Bellamy, cited three of the factors set out in Section 8 London Local Authorities Act 1991 (The Act) as being reasons for which an application may be refused. These are:

 

a)    Mr Aslim the licence holder can reasonably be regarded as not being a fit and proper person to hold a licence,

b)    The premises have been or are being improperly conducted,

c)    Mr Aslim has within the past five years been convicted of two offences under the London Local Authorities Act 1991.

 

The convictions were made on 25 August 2015 at Ealing Magistrates Court following not guilty pleas from Mr Aslim. The offences were the failure to keep proper and accurate client records, and failing to apply for an apprentice to be included on the licence. He was fined and ordered to pay costs.

 

The other issues related to further charges against Mr Aslim due to be heard at trial for allowing a minor to be pierced without written parental consent, and failing to state on his application that he had the two convictions referred to above.
