Notification of decision following a Licensing Panel hearing to determine an application for a premises licence

 

PREMISES: Nova Restaurant, 18-20 Chiswick High Road, Chiswick W4 1TE.

TAKE NOTICE:

 

THAT following a hearing before the Licensing and General Purposes Sub

Committee (the Licensing Panel)

 

ON 23 March 2017

 

HOUNSLOW COUNCIL, as the Licensing Authority for the premises

 

RESOLVED TO TAKE THE FOLLOWING STEPS IN RELATION TO THE PREMISES LICENCE AS APPROPRIATE TO PROMOTE THE LICENSING OBJECTIVES:

 

That the application for the variation of a premises licence be GRANTED IN FULL and on the terms and conditions contained within the application to include any applicable mandatory conditions.

 

The following conditions were removed from Annex 3 of the Premises Licence:

 

1)    Two SIA approved door supervisors and a toilet attendant will be present on Friday and Saturday nights from 19:00 until closing; and

2)    A Clubscan system will be installed and used on Friday and Saturday nights at the manager’s discretion from 19:00 until closing.

 

 

Licensable activities:

 

Supply of Alcohol on the premises

 

Monday to Saturday: 10:00hrs-00:00hrs

 

Sunday: 10:00hrs-23:00hrs

 

 

Provision of Late Night Refreshment

 

Monday to Saturday: 23:00hrs-00:00hrs

REASONS:

 

The Licensing Panel carefully considered all the relevant information including:

 

·       written and oral representations by all the parties

·       the Licensing Act 2003 and the steps appropriate to promote licensing objectives

·       the guidance issued under section 182 of the Licensing Act

·       Hounslow Council’s Licensing Policy

·       the Human Rights Act 1998

 

 

This was an application for the variation of the premises licence under section 17 of the Licensing Act 2003 in respect of Nova Restaurant, 18-20 Chiswick High Road, Chiswick W4 1TE. 

 

One representation was received from three residents (members of the same family at one address) concerned that the variation of the licence could result in the resumption of public nuisance in the form of noise and anti-social behaviour previously experienced from the premises. The Panel noted that no representations were received from the police or other responsible authorities.

 

Mr George Louki advised that his family and owned and run the neighbouring shop for more than 40 years and lived above their shop. Since the premises had become a pub and then the Revolution bar they had suffered severe problems from noise and anti-social behaviour (ASB) such as littering, numerous incidents where their shop window had been broken and, since the introduction of the smoking ban, issues with tobacco smoke entering their home from smokers congregating outside. Due to the raised insurance access from frequent damage he estimated that the family had been forced to spend around £10,000 on repairing their shop front over the last 15 years. On one occasion a mass brawl had resulted in their shop being very seriously damaged.
