Notification of decision following a Licensing Panel hearing to determine a review application for a premises licence submitted under s51 of the Licensing Act 2003

THAT following a hearing before the Licensing and General Purposes Sub

Committee (the Licensing Panel)

 

ON 11 April 2017

 

HOUNSLOW COUNCIL, as the Licensing Authority for the premises

 

RESOLVED TO TAKE THE FOLLOWING STEPS IN RELATION TO THE PREMISES LICENCE ASAPPROPRIATE TO PROMOTE THE LICENSING. OBJECTIVES:

 

That the Premises Licence for King Karahi, 177 Lampton Road, Hounslow, be varied by the addition of the following conditions:

 

 

1)  At all times when the premises are open for licensable activity, the Designated Premises Supervisor or other nominated staff member shall ensure that customers’ vehicles are parked legally outside the immediate front of the premises and within the car park. The public highway must be kept clear so that customer parking does not become a nuisance to local residents.

 

2)    A person is required to be engaged in order to manage the behaviour of visitors outside of the premises and ensure that no patrons remain on the premises or in the car park after 23:45; this person is required to be SIA qualified when there is an event taking place at the premises with 50 or more customers/guests present.

 

3)  All windows and doors of the licensed premises are to be double glazed.

 

4)   The exemption under the Live Music Act 2012 is removed so that the conditions set out in Annex 3, paragraph 2 of the amended premises licence have effect.

 

Reasons

 

The Licensing Panel carefully considered all the relevant information including

-       Written and Oral representations by all the parties

-      The Licensing Act 2003 and the steps appropriate to promote the Licensing Objectives

-       The guidance issued under section 182 of the Licensing Act 2003

-       Hounslow Council’s licensing policy

-       The Human Rights Act 1998

 

This was an application for a review of the premises licence under s51 of the Licensing Act 2003 in relation to King Karahi, 177 Lampton Road, Hounslow. The application was submitted by a Council Enforcement Officer and was based on incidents and concerns surrounding the prevention of public nuisance licensing objective.

 

Seven representations were received from other persons in relation to continued anti-social behaviour (ASB), public nuisance and public safety. The main issues raised involved anti-social parking in the immediate locality, specifically directly outside and directly opposite the venue as well as noise and other ASB from customers of the venue, shouting and playing loud music from cars until the early hours.
