That the Cabinet Member for Corporate Strategy, Planning and Regeneration agreed to the recommendations of the report as follows:

1.     That the Cabinet Member approved the allocation/earmarking of the Layton Road Car Park site, Brentford for a permanent Free School, to be funded as set out in paragraph 3.14 of the submitted report.


2.     That the Cabinet Member approved the termination of the existing 5-year lease with Fulton Holdings Limited on the Layton Road Car Park, subject to exchange of contracts and planning consent for the proposed Free School, whilst the termination of the existing lease, which has 2 years unexpired on the term, will result in the loss of the annual rent of £50k (payable by equal quarterly payments).


3.     That the Cabinet Member noted the draft Heads of Terms with Hodson Developments for residential and the Floreat Education Academies Trust for permanent accommodation on the Layton Road Car Park site within confidential Appendix 1 and delegated authority to the Executive Director Regeneration Economic Development and Environment (‘Director’) to negotiate detailed terms and enter into an agreement for a disposal of the Layton Road Car Park site identified in the Heads of Terms or terms of substantially like effect.


4.     That, subject to recommendations 1 to 3 above, the Cabinet Member delegated authority to the Executive Director to consider the two options for disposal namely:


Option A - The land assembly of the Council Car Park site with the adjoining two sites controlled by Hodson Developments via freehold land disposal for residential use conditional upon the freehold land sale from the developer to the Department of Communities and Local Government (DCLG) to deliver the construction of the Free School on the developer’s land;


                        Option B – The disposal of the Car Park site on the basis of residential use to enable the provision of the Free School by the Council granting a 125 year lease to the DCLG/Floreat Education Academies Trust, as set out in the report.


                        These two options are to be explored simultaneously with ‘Option B’ being the fallback position for the Council in the event Option A is no longer viable with the developer.


5.     That the Cabinet Member delegated authority to the Executive Director to determine whether to appropriate the site for planning purposes, and if so to take all steps required to appropriate the site prior to its disposal and take all steps necessary so as to secure the satisfactory disposal of the site, by way of a 125 year lease under Option B.


6.     That the Cabinet Member delegated authority to the Executive Director to negotiate, enter into a deed/deeds of variation for the release of any covenants that might affect the land and where the land is appropriated for planning purposes in reliance on section 237 of the Town and Country Planning Act 1990, the Council shall be indemnified by the developer against any compensation requirement.
