Decision on SEV application by Kaprice, 236a High Street, Hounslow. The Licensing Committee reconvened to reach a decision on the application for a Sex Entertainment Venue (SEV) Licence from Kaprice, 236a High Street, Hounslow. Decision: The Licensing Committee reconvened on 21 August 2012 to decide on the application for a Sexual Entertainment Venue (SEV) Licence by Kaprice, 236a High Street, Hounslow heard on 24 July 2012.
Having considered the application, the written representations, submissions from all the parties at the hearing on 24 July 2012, the relevant legislation, the Home Office SEV Guidance for England and Wales and the Council’s Statement of Licensing Policy, the decision of the Committee was to refuse the Sexual Entertainment Venue (‘SEV’) Licence application under Paragraph 12(3)(d) of Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 as amended (‘Schedule 3’).
In arriving at this decision the Committee considered both the mandatory and discretionary grounds for refusal. It found that none of the mandatory grounds applied as set out in paragraph 12(1) of Schedule 3. It then considered the discretionary grounds for refusal as set out in paragraph 12(3).

Decision In exercising its discretion the Committee decided that the grant of an SEV Licence in respect of Kaprice at 236a High Street, Hounslow, would be inappropriate having regard to the character of the relevant locality and the use to which any premises in the vicinity are put as set out in paragraph 12(3)(d)(i) and (ii) of Schedule 3.
Reasons In making its decision the Committee considered the area that represents the relevant locality and took into account the fact that this does not need to be an area with defined boundaries. As such the Committee determined that for the purpose of this application it was sensible to consider the area that would be likely to be affected by the presence of an SEV and that which local people would regard as being part of the locality. The consensus of opinion was that the town centre should be considered as the relevant locality.

The locality is a mix of residential streets which include a number of family houses and flats, a range of shops serving the community, and the schools/nurseries, places of worship and community halls/facilities listed above.
