Councillor Jabbal advised that he had received a letter and seen a presentation at West Area Forum in connection with the application.

 

Item 4: Land at Clockhouse Lane, Bedfont

 

Councillor Jabbal advised that the item had been discussed at West Area Forum, but that he had no pre-determined view. Councillor Collins declared that his son was a driver at Feltham Fire Station.

The minutes of the meeting held on 14 June 2012 (supplementary report) were agreed.

 

Matters Arising

 

Councillor O’Reilly asked for legal advice as to whether it would have been appropriate for the Cabinet Member for Housing and the two Hounslow Homes Board members to have declared an interest on the Boulton House application. Benita Edwards, Legal Officer, advised that, under the old Code of Conduct, where Members were appointed to bodies by Borough Council it was a personal interest but not necessarily prejudicial. The guidance provided an exemption to disclosure  of such personal interests (item 4,page 1 refers).

 

Retrospective Factual Amendment

 

The retrospective factual amendment, raised by officers and the applicant, to the minutes of the meeting held on 26 April 2012 was agreed. The amendment included an additional condition, as follows:

No demolition or construction work shall take place on the site except between the hours of 8:00am  to 6:00pm on Mondays to Friday and 9 :00am to 1:00pm on Saturdays and none shall take place on Sundays and Public Holidays without the prior agreement of the Local Planning Authority.

1. In order to safeguard the amenities of adjoining residential properties

Cathy Gallagher, Assistant Director – Environment Department (Regulatory & Development Services) highlighted the main points in the report.

 

In response to questions, she advised that the application was for the erection of temporary tents. The tents could be put up for 28 days without planning permission and the application was to extend that time for a further period until 30 September.

 

Nick Woods, Head of Traffic, advised that he had no concerns about coaches travelling to and from the site. There was no prescribed number of movements and it would depend on what they were deployed to do. He believed that the road network could cope for the short period

 

Approval was moved by Councillor Cadbury and seconded by Councillor Curran.

 

Members voted unanimously in favour of the officer’s recommendation for approval.

 

Resolved:

 

That planning permission for planning application 000403/V/P6 for the erection of a temporary accommodation camp for military personnel to provide security support for the London Olympics and Paralympics at Ministry of Defence CV Depot, Elmwood Avenue, Feltham be approved, subject to the conditions set out in the report.

Councillor Jabbal advised that there had been support for the proposals from West Area Forum, but there had been some concerns raised, particularly with regard to traffic generation.

 

Nick Woods advised that he had looked at both the Clockhouse Lane and Ascot Road applications (the next item on the agenda) in terms of traffic being generated as the sites were close together. He expected there to be approximately 95 lorry trips per day over a 12 hour day. In terms of capacity and in particular the impact on the junction with Clockhouse Lane, he felt that the roads would be able to cope and advised that Transport for London were satisfied too.

 

Planning permission had previously been given for a hotel on that site, so there would have been traffic movements related to that use, including delivery vehicles and coaches.

 

Councillor Cadbury commented that she supported the proposals in principle; she felt that it was inevitable that, with an international airport nearby, there would be a demand for a logistics premises and that the Authority should ensure that the land was available and the application supported. She was concerned, however, about the 19th century road network and hoped that support and funding for upgrades to the road and the Victorian brick hump-back bridges would be sought.

 

Mr Woods advised that he hoped to secure some funding for footways but the scale of the developments and likely traffic generation was not sufficient to warrant contributions towards the bridge. Funding for the bridge would be considered through the PFI.

 

Councillor Collins declared that his son is a driver at Feltham Fire Station and went on to ask about full access for emergency vehicles if lorries were stacking up at the roundabout. Mr Woods advised that the roundabout could cater for all emergency vehicles and large articulated lorries.

 

Councillor Dennison asked about the basis for including funding for footpaths under the S.106 agreement. Mr Woods advised that it was partly to open up access for people to the bus routes, which were poor in the area although it was open to the Committee to put the funding into a pot towards road and bridge upgrades. Councillor Dennison asked Mr Woods to look into those options.

 

Councillor Curran moved approval, which was seconded by Councillor Gopal Dhillon.

 

Members voted unanimously in favour of the officer’s recommendation for approval.

·        Employment and Job Brokerage provisions for local people (£100,000 – based on an expected job creation of 40 full-time staff)

·        Construction training provisions for local people (£17,120 – based on construction costs of £6.848M)

·        Green Belt Improvements (£11,099.34 or off-set against the provision of new public footpaths on the adjoining Green Belt) Members asked officers to look into the possibility of putting the proposed S.106 funding for green belt improvements, along with other monies from other small schemes in the area into a pot towards road upgrades and upgrades to the Victorian humpback bridges around the site instead of putting the money towards new public footpaths.

·        Green Travel Plan

·        Section 106 monitoring fees (£500 per obligation and £3000 per Travel Plan)

 

b)     That the satisfactory legal agreement or unilateral undertaking outlined above shall be completed and planning permission issued by 27/07/2012, or such extended period as may be agreed in writing by appropriate officers within the Department of Environment or within Legal Services.

 

c)      That, if the legal agreement or unilateral undertaking is not completed by the date specified above or any agreed extended period, authorisation for the Director of Environment or the Assistant Director – Environment Department (Regulatory and Development Services) or the Development Control Support Manager to refuse planning permission for the reason that the proposal should include planning obligations required to make the development acceptable in planning terms, in accordance with Regulation 122 of the Community Infrastructure Levy Regulations 2010 development plan policies and the Planning Obligations SPD, as described in Section 8 of the report, be approved.

Cathy Gallagher presented the report and advised that significant amounts of S.106 funding had already been secured through the previous scheme, the largest contribution being the sum towards green belt improvements.

 

In response to questions about traffic congestion, Nick Woods advised that a full traffic impact assessment has been carried out by the original developer and modified to subsequent developments. The carriageway would be widened to two lanes in each direction along the frontage of the site and a four arm traffic signal controlled junction would be installed to provide access to the Bulls Bridge Industrial Estate.

 

Councillor Cadbury raised concerns that the application would block off potential linkages between the Market and adjacent sites. Ms Gallagher confirmed that there were no links currently but advised that the scheme worked for the development in the application; any other scheme would need to work in its own way and could not be considered as part of the application on the table.

 

The Chair asked that officers look at future links to adjacent sites and speak to Councillor Cadbury about any future plans for the area.

a)     That authorisation for the Director of Environment or the Assistant Director – Environment Department (Regulatory & Development Services) or the Development Control Support Manager to grant planning permission for planning application 01032/E/P36 for the proposed construction of an employment development to comprise of 9 self-contained units (B1/B2/B8 use) and associated works at Western International Market, Hayes Road, Southall be approved, subject to the conditions set out in the report and the securing of the following planning obligations by the prior completion of a satisfactory legal agreement or unilateral undertaking made under S.106 of the Town and Country Planning Act 1990, or other appropriate legislation, the exact terms of which shall be negotiated by appropriate officers within the Department of Environment on the advice of the Assistant Director, Corporate Governance:

 

·        In assessing the recent consent for the data centre to the south of this site it has been established that the data centre and this employment scheme broadly relate to the previous employment scheme in floor area and impact and as such previous payments have been offset against these including;

·        Transport:  a payment of £25,000 has already been received.

 

·        Employment & training: A payment of £140,000 has already been received and allocated to three separate schemes;

 

·        Section 278 works: s278 works have already been agreed.  The legal agreement for this site will ensure its implementation prior to the commencement of development.

·        Construction Training

Cathy Gallagher advised that the application was to vary the existing legal agreement to improve the scheme. The applicant wished to phase certain payments and redistribute others. The Council would not lose any money from the scheme but the variation would help to get occupants onto the site.

 

In response to questions, she advised that long stop clauses would be included in any amendment to the agreement to ensure that payments were still made, even if anticipated floor spaces were not achieved. She was able to assure Members that this was stated in the contract and that the applicant would have to commence payments; it would not be possible to operate on the site if the payments were not made.

 

The Chair advised that the Committee would support officers in tightening up the legal agreement as much as possible.

 

Approval was moved by Councillor Fisher and seconded by Councillor Collins.

 

Members voted unanimously in favour of the officer’s recommendation for approval.

 

Resolved:

 

a)     That authorisation for officers to negotiate a variation to the existing legal agreement made under Section 106 of the Town and Country Planning Act 1990 and or other appropriate legislation, the exact terms of which shall be negotiated by appropriate officers within the Department of Environment on the advice of the Assistant Director, Corporate Governance, to achieve the above alterations be approved.

 

b)     That authority for officers to consider an alternate redistribution of the Eastern Triangle monies, if it is considered that they are not required at the Greenham Triangle site, be approved.

Cathy Gallagher presented the report. In response to questions about the consultation, she advised that more people had been consulted on the original application but, because the principle was already established and the neighbour had been the only one who responded before, the neighbour had been informed and a site notice had been posted.

 

Councillor Dennison felt that, if the car park was going to be there permanently rather than just for five years, it might have been better if officers had consulted further.

 

Approval was moved by Councillor Dennison and seconded by Councillor Collins.

 

Members voted unanimously in favour of the officer’s recommendation for approval.

 

Resolved:

 

That removal of condition 14 (removal of overspill car park after five years) of permission 00676/88/S23 for the erection of a single storey extension and roof terrace to the south elevation to provide conference and dining facilities together with the creation of 50 new visitors’ car parking spaces dated 08/02/2005 at Hounslow Civic Centre, Lampton Road, Hounslow be approved, subject to the conditions set out in the report.

Cathy Gallagher highlighted the main points in the report.

 

In response to questions, she advised that there had been an increase in the use of the car park and although the Travel Plan had been implemented in part, there was still a need to focus on the Plan in order to reduce the use of private cars.

 

Nick Woods advised that the barrier was controlled by security staff and access was only granted to those using the Conference Centre or Citizenship use. There would be no charge to use the car park

 

In terms of proposed improvements, there would be new surfacing and gravel or logging to provide aisles. The surfacing would be an interlocking structure, which would be strengthened and reinforced to provide some stability. Usage was very much ‘tidal’ with everyone entering at the same time and leaving at the same time. Mr Woods felt that one combined entrance and exit point was the more sensible than a separate entrance and exit.

 

Several Members mentioned concerns about security and made the following comments:

 

  • There was no CCTV for the overflow car park or the visitor’s car park. Members felt that there should be on both and asked that it be addressed as a condition on the application. Councillor Barwood also mentioned that the barrier to the Members’ car park had fused and wouldn’t go up. She asked officers to ensure that the new cabling worked properly and felt that security would have been able to see her if  CCTV cameras had been there.
  • Members felt that the application could be an opportunity to upgrade the lighting for the car park and the area in general, which would improve security.
  • There had been recent drug related activity going on in the car park and Members asked for ‘secure by design’ to be looked at.
  • As a ‘quick fix’ it was suggested that the lower branches on the trees be trimmed back to allow more light from the existing lights.

 

Councillor Jabbal advised that he still had concerns that the Travel Plan was never implemented, particularly as the Council always insisted that every developer submitted a Travel Plan with their application. He felt that the Council’s own Travel Plan should be looked at by an independent body.

 

Ms Gallagher advised that the principles of the Travel Plan were the same throughout and that the Council’s own officers were very thorough and committed to those principles. The reason the Travel Plan was included in the report was because there had not been as much progress as expected. It was the responsibility of the Local Authority to put it in place, which was separate from the Planning Authority’s responsibilities. Mr Woods added that there was concrete evidence that the Travel Plan was working; there was a new cycle shed and the result had been that there was an increase in cycling to the Civic Centre.
